    An event planning business organized as an LLC, corporation, or partnership files its formation documents with the South Dakota Secretary of State's Business Services office through the sosenterprise.sd.gov portal. A sole proprietor need not register an entity, but anyone conducting business under a name that does not plainly show each owner's true surname must file a fictitious (DBA) name statement under SDCL 37-11-1 - filed electronically with the Secretary of State or on paper with any county Register of Deeds, signed before a notary. South Dakota has no 'county clerk' filing office. DBA filings must be renewed every fifth year. Event planning and coordination services are taxable in South Dakota, so a separate (free) sales tax license from the Department of Revenue is also required.

Unlike many states, South Dakota taxes services broadly: state sales and use tax applies to all sales of products and services, and gross receipts under SDCL 10-45-1 include the total consideration for services sold, with no deduction for the retailer's own labor, materials, or costs, and (outside construction services taxed under chapters 10-46A/10-46B) no deduction for charges for services necessary to complete the sale even if separately stated. Any business with a physical presence in South Dakota must hold a sales tax license. Collect and remit 4.2% state sales tax plus applicable municipal sales tax (generally 1-2%) on your coordination fees and on any tangible goods you sell. If you sell at a special event, note that a municipal gross receipts tax may apply to ticket sales or admissions, and tourism tax applies at spectator events; temporary sales tax licenses are separately required for vendors at the Sturgis Rally and the State Fair.

    Rapid City has no general business license. The city's licensing page states the Finance Office (605-394-4143) licenses only adult-oriented businesses, central station service, ice cream vendors, pawn/precious metals and gems/secondhand dealers, refuse hauling, security, sidewalk vending, taxi, transportation network, and alcohol-related businesses or events, and adds that if you do not have one of those businesses the Finance Office does not require a business license. Event planning is not on the list. If you work from home, file a no-fee Home Occupation Certificate with Community Development under Rapid City Municipal Code 17.50.350. Individual events using city streets, parks, or public property still need their own city approvals, and alcohol service at an event requires a city alcohol license.

  2. Rapid City Special Event Permit (for events in public spaces)

    When coordinating events using Rapid City public parks, streets, plazas, or venues, a Special Event Permit is required (Municipal Code 12.20), administered by Parks & Recreation. Requires a completed application, detailed site plan, and Certificate of Insurance, submitted no later than 90 days before the event. As the event planner, you may obtain this on behalf of your client.

    Pennington County Planning and Zoning regulates only unincorporated land outside city limits; there is no county 'Temporary Use Permit' product.
