Businesses located within Orlando city limits must obtain a City of Orlando Business Tax Receipt before applying for the county receipt. For home-based cottage food operations, apply through the City of Orlando's permitting portal. The kitchen area used for production must not exceed 25% of the total home square footage per Orange County requirements.
Orange County Business Tax Receipt
After obtaining the City of Orlando Business Tax Receipt, a separate Orange County Business Tax Receipt is required. Home-based businesses without alterations to the home do not require a building permit. The receipt is issued annually (October 1 – September 30) by the Orange County Tax Collector.
Florida State Requirements

Under Florida's Cottage Food Law, cottage food operators producing non-potentially-hazardous baked goods, candies, jams, and similar products are exempt from FDACS licensing and are not inspected by any state agency. Annual gross sales must not exceed $250,000. All products must be prepackaged with a label stating 'Made in a cottage food operation that is not subject to Florida's food safety regulations' in at least 10-point font. Products may be sold directly to consumers including via website and social media within Florida.
