    Massachusetts does not license photographers. There is no state board and no occupational licence for the trade, so nothing needs to be applied for before you take paid work. What does apply are the general business obligations. If you trade under any name other than your own legal name you must file a business certificate with the clerk of the city or town where the business is located, under M.G.L. c.110 s.5. If you form an LLC or corporation you file with the Secretary of the Commonwealth. And sales tax is a genuine trap for photographers: under DOR Directive 11-4, where the final product is delivered in a tangible medium such as a print, album, disc or DVD, the whole charge is taxable including your shooting fee, even if it is separately stated. Only purely digital delivery, and separately stated sitting fees the customer is not obliged to convert into a purchase, fall outside the tax.

    The Massachusetts sales tax is 6.25% on sales of tangible personal property; services on their own are not taxable. For photographers, DOR Directive 11-4 sets a broader rule than most people expect: where the final product is delivered in a tangible medium — a print, a wedding album, a DVD or disc — the photographer's entire charge is taxable, including the shooting or event-coverage fee, and it stays taxable even when that fee is separately stated on the invoice. Two carve-outs exist. If the images are delivered only as a digital download or FTP transfer, there is no transfer of tangible personal property and nothing in the transaction is taxable. And a separately stated sitting fee is not taxable where the customer is obligated to pay it but is not obligated to buy any tangible item, under the Miller Studios rule — if they then choose to buy a print, tax applies only to the print.
