Remote sellers and marketplace providers with more than $100,000 in gross sales into South Dakota in the previous or current calendar year must also license and remit.     To become a Notary Public in South Dakota, apply for a commission through the Secretary of State's office (500 E. Capitol Ave., Suite 204, Pierre, SD 57501, 605-773-3537). The process: obtain your notary seal first (rubber, electronic, or embossing; circular, square, or rectangular; showing your name exactly as you will be commissioned plus 'Notary Public' and 'South Dakota', and the word 'seal' if a rubber stamp); complete the Notary Application with a legible imprint of the seal and your physical residential address (a P.O. box or business address alone is not accepted); complete and sign the Oath portion before the appropriate county entry; and mail the application with the filing fee. Effective July 1, 2025, the surety bond and Personal Surety Form are no longer required - only the application and oath are filed. South Dakota requires no notary examination or training course. You are authorized to notarize only after the Secretary of State issues your Notary Commission Certificate. The same application form is used for new and renewal commissions. Note that the Business Services entity-filing portal does not handle notary commissions.

The City Finance Office (Auditor Division, 605-626-7023) issues licenses only for a specific enumerated list of activities: ambulance driver, ambulance service, garbage hauler, community event, day care, junk dealer, lottery notice, mobile home park, pawn broker, street use, shooting gallery, special event alcohol, taxi/motorbus company, taxi/motorbus driver, transient merchant/solicitor, and alcohol. Trades such as plumbing, HVAC, and pest control are not on that list and need no city business license. Their state-level licensing applies instead: plumbing through the SD Plumbing Commission, pesticide application through SD DANR, and there is no statewide HVAC or mechanical contractor license. A South Dakota sales tax license from the Department of Revenue is still required.
