Under M.G.L. c. 93, ss. 78-88, anyone selling health club services contracts in Massachusetts must maintain a surety bond for each individual club location, issued by a surety admitted to do business in the Commonwealth. The duty starts before you execute any health club services contract and runs for five years after the club first commences operation. The bond runs in favor of the Commonwealth for buyers who lose money because the club closes, fails to open, or refuses to honor the cancellation rights in section 82. A change in ownership does not release the bond as to buyers who signed while it was in effect, and bankruptcy is no defense for the surety. There is a narrow exemption for weight loss and control services with no physical exercise facilities or classes, where the contract does not bind the customer for more than 30 days and charges no initiation fee.

Massachusetts Requirements for Fitness Studio Staff (No State Trainer Licence, but AED Rules Apply)
Massachusetts does not license or register personal trainers or group fitness instructors, and there is no state board for the occupation — a studio is free to set its own hiring bar, and most require a certification from an accredited body such as NASM, ACE, ACSM, ISSA or NSCA plus current CPR/AED training. What is not optional is M.G.L. c.93 s.78A: a health club, which includes a fitness studio offering instruction or facilities for physical conditioning, must have at least one AED on the premises and at least one employee or authorised volunteer in attendance as a trained AED provider during all staffed business hours. That is a legal duty on the studio, not a hiring preference, and it is the reason CPR/AED training for staff is effectively mandatory rather than merely customary. If you also sell memberships or training contracts, the rest of the Health Club Act applies, including a surety bond under s.79.

Boston Building Permit & Certificate of Occupancy
If you are building out, renovating, or changing the use of a commercial space for your fitness studio, you need building permits from Boston's Inspectional Services Department (ISD) — not Suffolk County, which has had no county government or permitting authority since 1999. A Certificate of Use and Occupancy is required before you can legally occupy the space; ISD will not issue it until the building permit has final sign-off from each trade inspector and copies of all associated permits (electrical, low voltage, fire alarm, plumbing, gas, sprinkler, sheet metal) are finalized. Depending on occupant load, stamped drawings approved by ISD and the Boston Fire Department are also required.

Boston Fire Department — Place of Assembly Permit
Section 27.02 of the Boston Fire Prevention Code requires a permit from the Boston Fire Department to operate a Place of Assembly, which is what a fitness studio holding a substantial number of people becomes. The Fire Prevention Division requires three sets of egress plans on minimum 24x36 inch sheets sealed by a registered design professional, showing the code of record and the use and occupancy classification as approved by ISD, and the plans must be kept on the premises at all times. Depending on the space, the department also asks for a current fire alarm record of completion, sprinkler or NFPA reports, monitoring company letter, kitchen hood tag and cleaning contract, narrative evacuation plans, extinguisher tags, flame certifications for interior finishes, a fire escape report (due every five years), and the annual fire pump test report. New owners, a new business, or a name change all trigger the submission.
