All businesses operating within San Diego city limits must obtain an annual Business Tax Certificate from the City Treasurer. The fee is based on number of employees: $34/year for businesses with 12 or fewer employees, or $125 plus $5 per employee for 13 or more employees. A $4 state-mandated SB-1186 fee applies to all applications. Photography studios and freelance photographers operating from a home or commercial studio in San Diego need this certificate.
San Diego County Fictitious Business Name (FBN) Statement
If your photography business operates under a trade name other than your legal name, file a Fictitious Business Name statement with the San Diego County Assessor-Recorder-County Clerk. California law also requires the FBN to be published in a newspaper of general circulation in San Diego County once a week for four consecutive weeks within 30 days of filing.
City of San Diego Film/Photography Permit (public property shoots)
Commercial photography on City of San Diego public property — including parks, beaches, Mission Bay, and open spaces — requires a filming/photography permit from the city's Special Events & Filming office. Small shoots (one photographer with no crew or production vehicles) at San Diego beaches and parks do not require a permit. Larger commercial shoots or those asserting exclusive use of public space must register. There is no registration fee for most still photography shoots on city property.

California photographers must register for a Seller's Permit if they sell tangible personal property such as prints, albums, frames, or physical media. Photography services (session fees) where no tangible property is transferred, or where images are delivered purely digitally, are generally not taxable. The 'true object' of the contract determines taxability. San Diego County applies an additional 0.25% district tax on top of the base 7.25% California rate.
California Secretary of State — Business Entity Registration
If operating as an LLC or corporation, register your photography business with the California Secretary of State. LLCs pay a $70 filing fee and are subject to California's annual minimum $800 franchise tax (payable to the Franchise Tax Board). Sole proprietors operating under their own legal name do not need state entity registration.
